Mr. Sanders is a shareholder of the firm of Mariscal, Weeks, McIntyre & Friedlander, P.A. Since 1983, his practice has been in the areas of complex litigation and general business litigation including antitrust, contract, business tort, intellectual property, health care and eminent domain matters. Mr. Sanders has served as a Judge Pro Tempore, Civil Division, Superior Court of Arizona, Maricopa County. He has also served as the Chair of the Antitrust Section of the State Bar of Arizona, as a member of the Civil Rules Committee of the State Bar of Arizona, and is listed in Who’s Who in American Law.

Representative cases

  • Representation of Fortune 500 companies in defense of breach of contract, business tort, antitrust, and lender liability claims.
  • Defense of major oil refiner, marketer of petroleum products and convenience store operator in proceeding seeking to restrain $860 million acquisition of 1,740 retail sites.
  • Representation of insurer in connection with antitrust challenge by United States Department of Justice and Arizona Attorney General to most-favored nations clauses employed in provider contracts.
  • Defense of “Big 4” accounting firms in administrative proceedings
  • Representation of municipality in special action proceedings regarding scope of constitutional public use requirement for exercise of eminent domain power to advance public/private partnerships.

Publications and Seminars

Mr. Sanders has been a continuing legal education speaker on the topics of antitrust issues in distribution and marketing; litigating software license disputes; protective orders and the attorney-client privilege, recovery of attorneys’ fees and eminent domain. He is the author of Contract Provisions in Arizona Attorneys’ Fee Manual (4th ed. 2003).

Education

Mr. Sanders undertook his undergraduate education at the University of Aberdeen, Scotland (Henry Prize in Advanced Moral Philosophy) and the University of Virginia (B.A. 1979 with high distinction). He obtained his law degree from Cambridge University, England (B.A. 1981) and a graduate law degree from the University of Texas at Austin (LL.M. 1983). He is admitted to the Arizona and California (inactive) bars.
