Ken Hodson is an environmental attorney with broad experience in federal Superfund matters, environmental due diligence, hazardous waste, underground storage tanks and other federal, state and local regulatory matters. Mr. Hodson also has considerable "Brownfields" experience and has negotiated Prospective Purchaser Agreements on behalf of both public and private sector clients. Mr. Hodson has served as the Chairman of the Environmental and Natural Resources Law Section of the Arizona State Bar and currently contributes to the Arizona Bar's Environmental Law Manual as an editor and author.

Federal Superfund:

  • Motorola 52nd Street Site - represent PRP in negotiations with EPA

  • Silicon Valley TCE Release - represent landowner in CERCLA cost recovery litigation against PRPs

  • South Indian Bend Wash - representation of PRP in negotiations with EPA

  • Hassayampa Landfill - coordinating counsel for transporters

  • 19th Avenue Landfill - representation of potentially responsible party (generator)

State Superfund (WQARF): represent potentially responsible parties located within WQARF sites. Representation includes negotiations with Department of Environmental Quality and environmental consultants regarding the adequacy of proposed remedial measures and site closure.

Real Estate Due Diligence: advise clients with respect to the appropriate investigative and remedial measures that may be required in connection with the acquisition of real estate. Representation includes due diligence efforts undertaken in connection with the acquisition of large tracts of land, office buildings and commercial property.

Underground Storage Tanks: represent various industrial and commercial clients in connection with the investigation and remediation of underground storage tank sites. Representation includes conducting contractual negotiations with environmental consultants.

Landfills: represent landfills in connection with potential State and Federal Superfund liability, RCRA compliance matters and other regulatory and permit issues.
