Mr. Baxter has been an Associate at Mariscal, Weeks, McIntyre & Friedlander, P.A. since 2006. He practices primarily in the areas of commercial and construction litigation. His representation of clients includes all aspects of litigation in federal and state courts, including motion practice, discovery and trial. Mr. Baxter also frequently represents clients in administrative hearings in actions brought by regulatory agencies (e.g., Arizona Registrar of Contractors) and in various alternative dispute resolution forums, including arbitration and mediation.
Mr. Baxter’s recent engagements include participation in the successful defense of a major home builder in a AAA arbitration proceeding against allegations of concealment and misrepresentation regarding a newly constructed subdivision and surrounding property and in defeating certification of a class of homeowner plaintiffs in an action against a prominent homebuilder seeking in excess of $100 million in damages based upon various allegations of fraud and nondisclosure. Mr. Baxter also recently achieved a favorable settlement for a merchandise supplier client in a federal court suit involving defense of a breach of contract claim, and prosecution of a counterclaim for breach of contract and nonpayment, against a major retail food franchisor.
Education
Mr. Baxter is a 2006 cum laude graduate of Tulane University Law School in New Orleans, Louisiana. He received a Bachelor of Arts degree from the University of South Dakota in 1992.
