The Condemnation/Land Use Group represents both condemning authorities and landowners in connection with takings for construction of highways, public works, redevelopment and other projects. In addition, our extensive experience in real estate and business valuation enables us to assist a variety of clients in connection with the formation of redevelopment districts, the negotiation of project finance and municipal assistance agreements, and other complex commercial transactions.

In the land use area, we have actively participated in proceedings for the adjudication of statewide water rights, groundwater transfers and the certification of assured water supplies for real estate development and other projects.

Representative condemnation and land use matters include handling of the twenty cases involved in assembling the land required for construction of Bank One Ballpark (now Chase Field); the negotiation of various land acquisition contracts in connection with the establishment of the City of Scottsdale's McDowell Mountains Preserve; the negotiation and drafting of development and financing agreements for regional shopping centers in Arizona and Colorado; and the negotiation of the financing and acquisition agreements which led to the establishment of the Spur Cross Ranch Conservation Area.

Among other publications, one member of our condemnation practice group is a contributing author of “Nichols on Eminent Domain”, published by Matthew Bender, the leading treatise in the eminent domain field, and was a contributor and editor of the State Bar of Arizona's Commercial Real Estate Transactions Practices Manual. The same attorney serves as Associate Dean at the Sandra Day O’Connor College of Law at the Arizona State University College of Law where he teaches a courses on private property rights, title insurance, the law of eminent domain and other related subjects, and as a professor in The University’s Master of Real Estate Development (MRED) program under the auspices of the W.P. Carey School of Business.
